""NEW DELHI: Swan Telecom promoter Shahid Balwa was the among the 2G scam accused who latched on to the CBI director's submission in the Supreme Court on Monday that there were "conflicting" views of investigating officers in 2G scam cases and Aircel-Maxis case against former telecom minister Dayanidhi Maran and sought the internal notes to be made public to prove their innocence.

Balwa was first to be off the block in moving an application requesting the court to provide him with a copy of the sealed cover documents given to the court. The accused were keen on getting the file notings showing "conflicting" views out in public to be able to show the trial court that the investigating agency itself was not sure about the impeccability of the evidence in the cases against them.

But a bench of justices HL Dattu and SA Bobde stopped CBI chief
Ranjit Sinha's counsel Vikas Singh from revealing how the Aircel-Maxis case proceeded within the corridors of the investigating agency, and the manner in which its chief tried to save the case from being closed.

Singh talked of "conflicting" views while disputing counsel Prashant Bhushan's claim that the Aircel-Maxis case was treated as a watertight case by the investigating officers but the director was dragging his feet and delaying filing of chargesheet. The court stopped Sinha from revealing internal details, saying it would harm the trial which is in final stages. Singh said it's for this reason that he had submitted the file notings in sealed cover. "If I am forced to disclose all these things, it is going to help the accused," he said and charged Bhushan with forcing him to do so to help the 2G scam accused.

Senior advocate Ram Jethmalani said no evidence which could fairly assist the accused in proving their innocence should be suppressed. Both Bhushan and the CBI counsel, senior advocate KK Venugopal, opposed it.

The bench asked both Bhushan and the CBI to respond to Balwa's application by September 24 but sarcastically added: "He (Balwa) thinks we are going to give it to him!"

The sarcasm didn't end there. As Jethmalani was insisting on documents being given to the accused, the bench said: "We will give you every document to the accused, but only after the trial is complete."

Giving details of the Aircel-Maxis case, Singh said a myth has been propagated by Bhushan that the investigating officers had built a watertight case but the truth is that most of them had said there was something in favour of the accused and had even closed the case relating to alleged irregularities in the decision of
Foreign Investment Promotion Board (FIPB).

The decision to close the FIPB case was reversed at the rank of additional director and the director supported reopening of the case, Singh said and expressed his annoyance that despite all this the CBI chief was being accused of wrongdoing.
