NEW DELHI: The telecom industry termed the recent Supreme Court's adjusted gross revenue (AGR) verdict as a partial relief only, and believes that the 'pricing revival' would be critical for the long-term growth of the sector.

"The order came as a sort of a conclusion and closure for an issue that was long pending, so the industry is relieved from the perspective of its legal closure. However, it can be termed as a partial relief only," the Cellular Operators Association of India (
COAI) director-general SP Kochhar told ETTelecom.

The Delhi-based group represents
Bharti Airtel, Vodafone Idea, and Reliance Jio.

Kochhar further said that the growth of India’s telecom sector depends on higher tariffs since they continue to be very low, and therefore, the pricing revival would be critical for the long-term growth of the sector.

Last September, India's top court has asked the telecom companies to deposit the AGR-related outstanding in a staggered mode over the next 10-year term, and at least 10 percent of their dues by March 31, 2021, after months of intense arguments.

The court, according to the telco group, took cognisance of multiple threats to the industry’s well-being that included the depressed levels of average revenue per user, fraught competitive landscape, and surge in data usage even as the price of such data plans remained almost unviably low.

The government, according to COAI, should now also look into reviewing the definition of AGR.

"This (order) will give the crucial breathing space to few operators to figure out how they can reconfigure their business plans to stem the relentless flow of operational losses and garner the resources to make the sizeable annual payments to the Centre over the next decade," Kochhar added.

The development, following the continuance of the lowest average revenue per user in India's telecom market, has come as a breather for telecom operators particularly for ailing Vodafone Idea that had the maximum exposure of nearly Rs 58,254 crore, followed by Bharti Airtel's Rs 43,980 crore, and Tata Teleservices' Rs 16,798 crore,
BSNL's Rs 5,835.85 crore, and MTNL's Rs 4,352.09 crore, according to the telecom department's estimates.

"The Vodafone's recent victory in the international arbitration proceedings against India on the issue of tax liability of Rs 20,000 crore, coupled with the recent AGR ruling, has brought further respite to the telecom company," Sonam Chandwani, managing partner of Mumbai-based KS Legal said.

India's third-largest telco has narrowed down the net loss to Rs 7,218 crore in Q2, 2020-21, and telco's chief executive Ravinder Takkar said that the telco would not shy away from taking the first step in increasing telecom tariff.

Citing telecom experts, Kochhar said that the sector needs fresh equity and concession in various government levies to continue operations besides paying the annual installment of AGR dues, and added that the reduction in levies and floor tariffs for the data tariffs would be a must for the industry's sustainability.

The incumbents -- Reliance Jio, Bharti Airtel, and Vodafone Idea -- have been demanding the
Telecom Regulatory Authority of India (Trai) to quickly fix a floor for data tariffs for business sustainability. The sector watchdog, indicating the move as anti-consumer, though pushed the demand onto the backburner.
