Apple<\/a> is passing on the 2% equalisation levy<\/a>, aside from 18% goods and services tax<\/a> (GST), to Indian consumers who buy apps or any other product from its iTunes<\/a> or App store<\/a>. Experts said other companies, including Google, Amazon and LinkedIn, may follow in its footsteps and start passing on the cost to consumers.
Whenever “taxes or foreign exchange rates change, the company has to update prices on the App store<\/a>,” Apple<\/a> told its consumers on the site. “New equalisation levy of 2% in addition to the existing GST of 18%” will be levied on purchases, it said.
ET was the first to report August 25 that the big tech companies hadn’t paid the 2% equalisation levy, announced in the FY21 budget, due to lack of clarity.
Tax<\/a> experts said the levy applies to all non-residents engaged in or facilitating the online sale of goods or services subject to certain conditions.

Higher cost for consumers<\/strong>
“Principally, equalisation levy is charged on revenue as against profits and is payable irrespective of whether any profits are earned or not. And it is 2% of the gross consideration,” said Ajay Rotti, partner, Dhruva Advisors.
“Now that Apple has started levying the equalisation levy and GST on their apps, iTunes<\/a>, iCloud and other services they provide to Indian consumers, other internet giants too will have to follow this directionally,” said Girish Vanvari, founder of tax advisory firm Transaction Square. “The question however is whether the Indian consumer who's paying tax on this can take a credit of this or will this be a sunk cost.”
Apple, Google, Amazon and LinkedIn didn’t respond to queries. Companies have passed on similar levies to consumers in other countries as well, Rotti said.
India and the US are working to resolve their differences over the equalisation levy. The US opposes it on the grounds of “fairness.”
India has responded by pointing out a US Supreme Court ruling that said the physical presence of an online company was not required for imposing tax in a particular location. Most of the big tech firms facing the tax in India are US companies.
The government had, in this year’s budget, increased the scope of the equalisation levy imposed on cross-border digital transactions in 2016 in a bid to tax the advertising revenue that the internet giants earn from India. It includes any purchase by an Indian or India-based entity through overseas ecommerce platforms with effect from April 1.
Tax experts said the main objective of the government is to tax the revenues of digital giants that earn billions from India. When companies pass on the tax to consumers, it ends up as an escalation of costs for Indians, with little impact on the revenues of the tech giants, they added.
