The person privy to the matter also said that the state-run operator would conduct bidders meet and readdress queries from stakeholders to allay their apprehensions once the nationwide lockdown due to Covid-19 outbreak is lifted.

The development has come on the close heels of the Department for Promotion of Industry and Internal Trade (DPIIT) warning to the officials for flouting public procurement norms of 2017 and indicating that disciplinary action may be considered against erring officers in case restrictive conditions against domestic manufacturers are been imposed.

Meanwhile, the DoT has also taken a serious note on the matter, according to an another source.

The Telecom Equipment Promotion Council (
Tepc<\/a>) has cried foul, and in separate yet identical letters to the secretaries of DPIIT and the Department of Telecommunications (DoT) said that the state-controlled telco has done a 'serious policy violation' by putting stringent norms in the notice inviting tender (NIT) to discourage homegrown equipment makers.

Sandeep Grover, a senior Supreme Court counsel and partner at Delhi-based Ortis Law Offices said that certain eligibility criteria and conditions mentioned in the tender including, minimum turnover of Rs 8,000 crore each in the last two years, having substantial subscribers in at least two countries were 'demanding enough' to exclude the domestic telecom equipment manufacturers.

However, the person aware of the matter said that the public company has included the main condition that the potential bidding company must be registered and incorporated in India, and added that the Rs 8,000 crore eligibility criteria was as per the Central Vigilance Commission's (CVC) guidelines to conform that vendors should have strong financials.

BSNL<\/a> invited bids with one of the conditions saying that a parent company must be a manufacturer of the 4G radio access network, for the supply, deployment, and maintenance of 7,000 new 4G cell sites in two metropolitans being serviced by Mahanagar Telephone Nigam Limited (MTNL<\/a>) valued at nearly Rs 9,000 crore, in addition to up-gradation of 50,000 sites in different zones.

Following the stern approach adopted by the Ministry of Commerce, the state-backed telecom operator, according to the top court lawyer, should amend its tender document to accommodate domestic telecom equipment manufacturers as well.

The public-sector telecom carrier is expecting to procure next-generation equipment after six to eight months following the opening up of final bids, and the officials believe that the government would allocate the 4G spectrum within the current fiscal year.
