The competition watchdog had sought similar information from Facebook as well before giving its clearance recently to the social media company’s investment in Jio Platforms, the
Reliance Industries<\/a> unit that holds mobile services operator Reliance Jio and other digital businesses of the Indian group.

Google moved the commission in September seeking approval for its Rs 33,737 crore investment in Jio Platforms and a commercial pact to jointly develop entry-level Android smartphones. The application is currently under review.

Google, Jio and CCI didn’t respond until press time Sunday to ET’s emails seeking comment.

Among the things being studied by the CCI are how much of Google’s investment in Jio Platforms would go into handset development and manufacturing, said a second person.

Another person said the CCI had already reached out to various stakeholders, including device makers, to understand the market and the possible implications the deal could have on the rest of the handset industry.

\"Since most handset makers use Android as a platform, the CCI is trying to understand if any arrangements between Jio and Google could be exclusive, thus what it means in terms of access to Google's software for other device makers, especially at a time when the government is trying to make India a smartphone manufacturing hub and has come out with an incentive scheme. Does this (deal) mean other handset makers could suffer because of an arrangement between the two,\" this person said.

The CCI seeks clarifications from companies during the assessment process, a government official said. Apart from pre-filing consultations, the applicants require to provide substantial information on the deals, he added.

\"Google has large tracts of data residing with it and has a dominant position in the mobile OS space. The CCI will want to know details of whether Jio could gain access to this data or gain preferential treatment while making the Android phone, thereby affecting competition in the market,\" said Prasanth Sugathan, the legal director at Software Freedom Law Center.

\"Mere collaboration is not the issue; the question is whether Google would use its dominant position to tilt the market in favour of Jio,\" he added.

The CCI is looking into the deal even as greater global regulatory scrutiny is taking place into the operations and actions of US technology majors such as Amazon, Apple, Google and Facebook, amid concerns around their alleged anti-competitive behaviour.

Google dominates the search, video, maps and email segments in India. Nine out of 10 smartphones sold in India come with Google’s Android OS. Jio Platforms is the parent of Reliance Jio, India’s largest telecom company with nearly 400 million users.

Both also have similar services such as payments. Google Pay in India runs on the Unified Payments Interface (UPI), and is widely regarded as the market leader in this mode of digital payments market in India, processing an estimated 50% of the transaction volume every month, followed by Walmart-owned PhonePe and Paytm. The National Payments Corporation of India that manages the UPI system doesn't disclose platform-specific data on monthly transactions.

Facebook, in response to CCI’s questions about its purchase of a 9.99% stake in Jio Platforms, had assured the watchdog that its deal would only involve exchange of “limited data” related to facilitating ecommerce transactions, according to the regulator’s order made public on Tuesday. While clearing the deal, the CCI has warned both sides that anti-competitive conduct resulting from data sharing in the future could be taken up by the regulator.
