A division bench of Justices Poonam Bamba and Rajesh Shakdher adjourned the matter after WhatsApp’s counsel, senior advocate Harish Salve, said the Personal Data Protection Bill was yet to be passed by Parliament.
WhatsApp had given an undertaking to the central government that it would not enforce the privacy policy till the Bill was cleared, Salve said.
WhatsApp did not respond to an email seeking comment till press time Wednesday.
In January 2021, the CCI on its own had decided to look into WhatsApp's privacy policy, following allegations that its implementation allowing greater data sharing between WhatsApp and Facebook (the company later renamed itself Meta) would violate the Competition Act 2000. On March 24 last year, the competition watchdog directed its director general to probe the new privacy policy.
WhatsApp and its parent challenged CCI's order, but a single-judge bench of the Delhi High Court, on April 22, 2021, dismissed the pleas.
On Wednesday, the division bench said an order issued in January this year, extending the time for WhatsApp to respond to CCI notice, would remain in force.
On January 3, a high court division bench of Chief Justice DN Patel and Justice Jyoti Singh had cited the pending Data Protection Bill while adjourning the matter to March 30. Justice Patel has since retired.
The data-sharing policy seemed exploitative and could have exclusionary effects, which have the potential to undermine the competitive process and create further barriers to market entry, the CCI had said in its order. WhatsApp and its parent had also challenged the CCI's order asking them to furnish certain information for the purpose of the inquiry conducted by it.
India is the largest market for WhatsApp with more than 400 million users. The company has maintained that the privacy update for users of business services on its platform would not compromise end-to-end encryption.
