NEW DELHI<\/a>: Digital rights activists, who accessed and studied the order suspending internet<\/a> in several areas in Delhi on Thursday, point out that it was not issued from the \"right channels\" and, therefore, was \"illegal\".

Technology lawyer Mishi Choudhary said that internet can be suspended in India in the case of public emergency or public safety under the rules formed by the ministry of information technology under Temporary Suspension of Telecom Services (Public Emergency or Public Safety) Rules, 2017.

“It can only be ordered by competent authority like Union home secretary or state home secretary, but this order was not issued by them,” said Choudhary of SFLC, an NGO that works to strengthen digital rights. SFLC also runs an online tracker that documents cases of internet shutdowns in the country.

The document ordering the shutdown, labelled as “top secret\/classified” circulated on Twitter on Thursday. The order was signed by PS Khushwah, deputy commissioner, special cell, New Delhi.

Choudhary further elaborated that state governments sometimes suspend internet to maintain “public tranquility” under section 144 of the CrPC under the order of a DM, SDM or commissioner of police, even though it’s not the “right channel”. “Telecom service providers can challenge these orders because they are not coming through the right channels. But even though the business of these providers is impacted, we have not seen that happen yet, she added.

“The internet and communications shutdown in #Delhi is not under the telecom suspension rules of 2017, this is an illegal order,” tweeted digital rights activist Srinivas Kodali, echoing the same view.

Apar Gupta of the Internet Freedom Foundation also questioned the timing of the internet suspension. “The order was issued one day before protests and it seems the only purpose it aimed to serve was to prevent a peaceful gathering. It has no evidentiary material to justify why internet needed to be shut and does not even cite any section of the law that enables
internet shutdown<\/a>. It was in clear violation of our constitutional right to assemble,” he said.

Gupta added that though internet can be suspended under the IT Act and the Telegraph Act, even their constitutional validity has been challenged in the Gauhati high court. “The legal argument against internet suspension is that one cannot curb legal speech to curb illegal speech because it impacts millions of people. Our modern lives are intrinsically tied to the internet and one needs it to not just voice opinions, but for transportation, for financial transactions, for ordering food,” he added.
