<\/span><\/figcaption><\/figure> MUMBAI: Discovery<\/a> Communications has filed a writ petition in the Delhi High Court<\/a> submitting that Telecom<\/a> Regulatory Authority of India’s new consultation paper on tariff related issues for broadcasting and cable services is “marred by judicial impropriety” and fails to conform to the “fundamental tenets of transparency and objectivity”.

The Delhi High Court has already listed the broadcaster’s earlier petition challenging the entire new regulatory framework for the broadcast sector by the regulator – tariff order, interconnect regulations and quality of service regulations – for final arguments starting September 19.

Discovery filed the new petition seeking a stay order on the new consultation paper issued by
Trai<\/a> on August 16th, which the company feels will render the earlier petition infructuous. However, the court has refused to give an interim relief, but has asked the petitioner to approach again in case Trai makes any changes in the framework.

In its over 350-paged petition, a copy of which is accessed by ET, Discovery has argued that the Trai’s consultation paper is proceeding with a “pre-determined notion” that channel broadcasters have distorted the broadcasting market and consumer choice through perverse pricing and deep discounting and have therefore called for suggestions on the ways and means to remedy the situation.
