New Delhi: No one should be prosecuted under Section 66A<\/a> of the Information Technology Act<\/a> which was struck down in 2015, the Supreme Court<\/a> has said in an order to directors-general of police and home secretaries of all states.

SC on Wednesday also asked them to ensure that reference to Section 66A was deleted from all pending cases. SC's order comes after its direction to the Centre in the last hearing to ask chief secretaries where FIRs under the said section continued to be registered despite being declared unconstitutional in 2015.

UU Lalit<\/a>, justices S Ravindra Bhat and Ajay Rastogi also ordered that readers of the IT Act<\/a> should be apprised that the said section in the Act had been invalidated. The directions came during the resumed hearing of a petition filed by the Peoples Union for Civil Liberties, which said that police continued to invoke the section despite SC striking it down in 2015. The bench ordered that in all cases where citizens faced prosecution for violations of Section 66A, the reference and reliance<\/a> on the said section should be deleted.

The Supreme Court bench directed all DGPs, home secretaries and officers to order the entire police force to not register any complaint with regard to violation of the said section. The bench clarified that the direction was limited to Section 66A and if the crime had other facets where other offences were also alleged, those should not be deleted.
