Experts say the new chairman would have his or her task cut out in balancing the interests of the sharply divided but rapidly consolidating industry \u2013 helmed by the country\u2019s biggest business houses \u2013 which is facing high debt coupled with severe revenue and profitability pressures, while taking care of the interests of consumers, who have been the chief beneficiaries of Reliance Jio\u2019s entry in September 2016 with prices of voice and data hitting rock bottom.<\/p>
\u201cThe qualifications for the post as derived from Section 4 of the TRAI<\/a> Act, are as follows: A person having special knowledge of, and professional experience in telecommunication, industry, finance, accountancy, law, management or consumer affairs,\u201d the Department of Telecommunications<\/a> said in a document seeking applications posted on its website.<\/p> The tenure of the current chairman RS Sharma<\/a>, who took charge in late July 2015, ends on August 10. The term of the post is not exceeding three years or till the age of 65 years, whichever is earlier, the DoT notice said The end of Sharma\u2019s term will bring to a close a tumultuous period which saw the entry of Jio with free voice and data offers, triggering the bitterest of fights between the newcomer and the older operators \u2013 Bharti Airtel, Vodafone Idea and Idea Cellular \u2013 in the market place, and off it, with most of the issues going to the courts.<\/p> Major burning issues during his tenure include the mandate to compensate user for calls drops - struck down by the Supreme Court - besides the promotional offers offered by Jio to start with, points of interconnection that are needed to complete calls, the cuts in local and international termination charges, the latest tariff order which changed the definition of significant market power needed to identify predatory pricing and the need for making public all such plans that carriers offer to specific clients to retain them. All of these issues are now in courts or in the Telecom Disputes Settlement and Appellate Tribunal<\/a>.<\/p> The three incumbents \u2013 sometimes directly and sometimes through industry body Cellular Operators Association of India (COAI<\/a>) \u2013 have accused the regulator of bias against them and in favour of the new entrant, allegations that both Jio and Trai have rubbished.<\/p> Sandip Das, an industry veteran and a former managing director at Jio, said the new head needs to be a \u201cstatesman who will balance the competitive forces in the market place preventing destructive monopolies while inducing constructive competition that prevents incumbent inertia and profiteering\u201d.<\/p> \u201cHe\/she must understand that industry players are as much his\/ her wards as are the customers and must have a strong understanding of the financial interplay and implications of licensing, healthy companies and consumer affordability,\u201d Das said.<\/p> He added that the chairperson would need to grasp issues surrounding technology and its introduction in India, besides the gravity of issues like cyber security etc. Mahesh Uppal, director of Com First (India), a company that specialises in telecom policy<\/a> and regulation, said the new regulator shouldn\u2019t intervene when it\u2019s not needed.<\/p> \u201cThe most important thing for the regulator to do is to ensure that the market works and where it doesn't, to act. Conversely, it should not act or intervene if the market is working,\u201d Uppal said.<\/p> With competition heightening, the sector is also undergoing large scale consolidation at a pace never seen before, with the country\u2019s No 2 and No 3 carriers \u2013 Vodafone India and Idea Cellular \u2013 merging, and others like Norway\u2019s Telenor, Tata Teleservices and Tikona merging into No 1 carrier Bharti Airtel. Others like Reliance Communications and Aircel have wrapped up operations.<\/p> \u201cTrai has to be more about regulation and less of authority,\u201d Uppal said further. COAI director general Rajan Mathews said the new chairman should ensure that industry relations are \u201copen, fair, equal and participative\u201d.<\/p> <\/div><\/div>
