MUMBAI: The Bombay High Court<\/a> will resume hearing on petitions filed by top television<\/a> broadcasters<\/a> in the country challenging the sector regulator’s recent amendments to tariff rules on Wednesday.
A division bench of Justices SC Dharmadhikari and R I Chagla had on January 14 accepted the petitions against the amendments to the new tariff order (NTO<\/a>) notified by the Telecom Regulatory Authority of India (Trai<\/a>) on January 1 and told the regulator file its reply within a week before adjourning the matter to January 22.
Indian Broadcasting Foundation (IBF), Star and Disney India, Zee<\/a> Entertainment Enterprises, Sony<\/a> Pictures Networks India, and TV18 and Viacom18<\/a> have called the NTO “arbitrary and unreasonable” in their pleas.

Indian Broadcasting Foundation (IBF), Star and Disney India, Zee<\/a> Entertainment Enterprises, Sony<\/a> Pictures Networks India, and TV18 and Viacom18<\/a> have called the NTO “arbitrary and unreasonable” in their pleas.

They alleged that Trai’s amendments are “excessive, unreasonable, manifestly arbitrary, and without jurisdiction”, claiming that the amendments violate the Trai Act, 1997 as well as the petitioners’ fundamental rights as guaranteed under Articles 14, 19 (1) (a), 19 (1) (g), and 21, and constitutional rights under Article 300A of the Constitution of India.
The biggest pain points of the broadcasters include reduction in price cap to ?12 (from ?19) for channels available under bouquet, discount cap of 33.3% on bouquets under twin conditions, and limit of number of bouquets.
Broadcasters argue that Trai has failed to understand that it is not in the interest of the broadcasters to have un-consumable bouquets and that it is a wrong assumption that large numbers of bouquets are aimed to confuse users.
