India is missing out on the opportunity to become a data transit hub due to regulations around submarine cable systems<\/a> and cable landing stations<\/a>, a senior executive of Google<\/a> said on Wednesday.

Regulations around
lawful interception and monitoring<\/a> (LIM) compliance are seen as major deterrents to companies using India as a transit point for data travelling from the west to the Far East, industry executives said during an open house discussion conducted by the Telecom Regulatory Authority of India (Trai).

The regulator has given the stakeholders a week’s time to elaborate on these issues, and give suggestions based on global practices.

“India is a very large transit point, and some policy intervention is required to ease transit of data through India, if it is to capitalise on this huge business opportunity,” Anindita Samanta, strategic negotiator at Google, said.

Under the current regulations, companies using the
undersea cable network<\/a> in India for data transfer must be LIM compliant<\/a>. This entails getting compliance approvals from several agencies, including legal and judicial entities, and some ministries.

The LIM stipulation allows law enforcement agencies to tap into the data network and listen in when the need arises - for example, in case of a threat to national security. However, to do so, it requires justifiable cause and approvals before listening in on information.

This, however, is important when the information is flowing into India, said industry executives, adding that for data simply transiting through Indian shores, LIM compliance may not be paramount.

The open house discussion was held to debate on matters regarding the licensing framework and regulatory mechanism for submarine cable landing in India based on a consultation paper released by the sector regulator in December last year.

“Countries like Oman have managed to become significant transit hubs due to their policies and ease of doing business,” Mukesh Jain, head of special projects at Lightstorm Telecom, said. He added that charges like access facilitation charge and strict SLA (service licence agreements) add to the regulatory burden for entities wishing to use India as a transit hub.

This, in turn, prevents them from using Indian shores as transit points for their data transport, denying the country a lucrative business opportunity, he said.

Also present at the discussion were representatives from the three private telcos--Reliance Jio,
Bharti Airtel<\/a> and Vodafone Idea. They stressed the need to designate cable laying and repair under the critical and essential services and that these services have priority for permits-- in-principle and clearances from government agencies.

Setting up a cable landing station for traffic terminating in India also requires multiple permits, said Mahipal Singh, vice president, regulatory affairs,
Reliance<\/a> Jio, and urged streamlining of the approval process.

Airtel<\/a> reiterated that an entity wanting to set up a cable landing station for cables terminating in India should have a stake in the consortium that has built that part of the undersea cable network. Both Jio and Vodafone Idea opposed this view.
