Bengaluru: The Kerala High Court on Tuesday asked the central government whether it could guarantee that information collected by its Covid-19 contact tracing app, Aarogya Setu, would not be misused. The court sought a report on the app’s privacy safeguards from the Centre and posted the matter for further hearing next week. It did not pass any interim order.

A bench comprising Justices
Anu Sivaraman and MR Anitha was hearing a public interest litigation (PIL) filed by activist John Dayal challenging the central government’s order that public and private sector employees and those living in containment zones should mandatorily download the app. “Extraordinary times call for extraordinary measures,” Justice Sivaraman observed.

So far, three petitions have been filed in the Kerala High Court against Aarogya Setu and the central government directive. Counsel Jaishankar Nair, appearing on behalf of the central government, told the bench that data protocol norms were formulated on Monday to address privacy concerns. He said 130 Covid-19 hotspots have been identified with the help of the app, and lakhs of people were downloading it every day.
