\"\"MUMBAI:Reliance Communications<\/a> (RCom) said its lenders will oppose the insolvency court’s decision to start bankruptcy proceedings<\/a> against the debt-laden telco at a hearing in the appellate tribunal scheduled on Tuesday, driving the company’s shares as much as 11% higher. The appeals filed in the appellate tribunal against the National Company Law Tribunal (NCLT) admitting RCom and two subsidiaries to the debt resolution process and appointment of interim resolution professionals were mentioned for urgent hearing on Monday.

\nThe appellate tribunal set the hearing for May 29, Anil Ambani-controlled RCom said in a regulatory filing. Swedish telecom equipment maker Ericsson dragged RCom and its subsidiaries Reliance Telecom and Reliance Infratel to the
bankruptcy court<\/a> over non-payment of more than Rs 1,000 crore in dues. The three companies then appealed the NCLT’s order in the National Company Law Appellate Tribunal<\/a>. “All banks and financial institutions… have unanimously decided to oppose the NCLT debt resolution process,” RCom said. “Major lenders, including China Development Bank, State Bank of India and Standard Chartered Bank, have been formally impleaded to the appeal proceedings.”

\nRCom shares surged to Rs 15.85 on the BSE after the regulatory filing and closed at Rs 15.30, a 7.4% gain. RCom and its two units opposed the NCLT order, saying the Swedish company was an operational creditor.

\nThe bankruptcy court has already appointed IRPs who have taken over the running of the three companies and are tasked with reviving them and finding ways to repay the lenders. Asettlement between Ericsson and RCom is crucial to enable the telco to sell most of its wireless assets to Reliance Jio Infocomm for about Rs 18,000 crore and pare Rs 46,000 crore of debt. The bankruptcy proceedings have stalled the plan to sell the assets.

\nReliance Infratel is engulfed in a separate legal battle with HSBC Daisy Investments and other minority shareholders opposed to the sale of towers and fibre network to Jio. ET reported last Saturday that negotiations between RCom and Ericsson for a settlement have hit a stalemate with Ericsson rejecting two proposals of RCom.
