The government has pulled down its draft guidelines on data anonymisation<\/a>, the third such instance of a public consultation being removed this year.

The guidelines were put up for feedback by the
Ministry of Electronics and Information Technology<\/a> (MeitY<\/a>) on August 30.

Sources said the draft had been “released without adequate expert consultation.”

“It is a complex issue and needs wider consultation with other government departments and ministries as well. We will talk to experts again, look at global examples and examine them, and then put up the draft for public consultation in a few days,” a senior IT ministry official said, asking not to be named.

ET reported on September 2 that MeitY had invited public comments on the draft guidelines.

Data anonymisation is one of many privacy-enhancing techniques that removes or minimizes the identifiability of individuals in large data sets of personal information.

It reduces risk, and enables entities to process, share and publish data for various purposes, making it useful while optimising privacy.

The draft states that all e-governance projects apply data anonymisation as a norm and identify and record exceptions.

After hosting it on its egovstandards website, MeitY has removed it completely, said Prateek Waghre,
policy<\/a> director, Internet Freedom Foundation.

The webpage for the consultation, whose deadline for submission of comments was September 21, seems to have been updated.

Documents related to the consultation can no longer be found there. An archived version of the page confirms that the documents were previously listed on it.

This is the third such documented instance this year of a public consultation process being interrupted without any notice or acknowledgment.

Previously, the proposed draft amendment to the
IT Rules<\/a>, 2021 and the draft India Data Accessibility<\/a> & Use Policy, 2022 also faced similar issues.

“The draft India Data Accessibility and Use Policy was updated without any information to the public that it had been updated. The draft amendments to the IT Rules resurfaced a week after being taken down with a press note for context. MeitY should come clear on whether the public consultation is still on the draft put out in August. This quiet taking down of public documents sets an unhealthy precedent,” Waghre said.

Such actions reduce public trust in the policy consultation process and make it harder for interested stakeholders to engage with the government meaningfully, he pointed out.

MeitY had entrusted the Standardization Testing Quality Certification Directorate and the Centre for Development of Advanced Computing (C-DAC), Pune, to formulate standards and guidelines in the areas of e-governance.

These standards and guidelines shall ensure sharing of information and seamless interoperability of data across e-governance applications. One of the topics under e-governance applications is anonymisation of data.

Accordingly, C-DAC constituted a Working Group of 14 subject matter specialists whose primary goal was to frame guidelines for anonymising data when personal information is processed and shared, especially in various e-governance applications.
