A 'Right of Way<\/a>' (RoW) debate has broken out between the telecom ministry<\/a> and a clutch of key ministries -- from defence to road transport and railways -- over the charges to be paid for use of government land for developing telecommunication infrastructure essential for nationwide 5G rollout<\/a> and the Bharatnet<\/a> project for rural tele-connectivity.

With nearly 500 projects stuck over the issue, the telecom ministry is preparing to go to Cabinet to ensure that other stakeholder ministries only levy nominal charges for laying of the optical fibre network and setting up of poles, ET has reliably gathered.

This will, in most cases, require changes in the rules\/subordinate legislation of the other ministries and hence the need for Cabinet approval.

Inter ministerial discussions have so far been held on the RoW issue with the Ministry of Defence, Ministry of Road Transport & Highways, Ministry of Railways and the Ministry of Environment, Forests & Climate Change.

ET gathers that the bulk of the 500-odd telecom\/optical fibre project stuck are related to defence land -- either in border areas or cantonments.

At least a 100 of these stuck projects are held up due to the quantum of levies at the other three ministries, officials aware of the matter told ET.

MORTH, for instance, is seeking levies to the tune of 10% of the land's market value from the telecom ministry citing its rule books while the Ministry of Railways is learnt to have sought for near 6% of the market value of the land and advance payment at yearly rate for 10 years.

The Ministry of Environment & Forests also brings in
Net Present Value<\/a> (NPV) charges which are imposed for use of forest land.

Officials in some of these ministries said that while government to government contracts involving ROW were not an issue, the situation changes in case of involvement of the private sector.

Bharatnet is being implemented in the
Public Private Partnership<\/a> (PPP) mode.

\"We are not authorised to allow use of our land by profit-making private players at the throwaway prices which are being sought. The Cabinet has to permit it and authorise us to do so. The matter is under discussion,\" a top official involved in the inter ministerial deliberations told ET.

On the other hand, the telecom ministry cites the government mandate to reach connectivity to the remotest areas in the country.

In communication sent to several ministries and states in April, the department has noted that there are still 'inconsistencies in RoW related fees and procedures across the country'.

It drew attention to the 'high costs and procedural delays in RoW permissions' and how these 'impede the development of telecommunications infrastructure affecting the availability of adequate telecommunication infrastructure and hence, hamper provision of telecom services at affordable prices'.

\"For successful pan India 5G rollout, a huge number of poles would need to be erected for deployment of small cells. In addition, the existing street furniture would also need to be explored for deployment of small cells,\" the department wrote in the communication.

\"While most state governments have aligned their rulebooks and charges and levies to the draft Right of Way
policy<\/a> guidelines of 2016, we are facing problems with a few central ministries. Due discussions have been held and the option to move a cabinet proposal is under active consideration to resolve it,\" an official with knowledge of the issue said.
