BENGALURU: Software industry<\/a> grouping Nasscom<\/a> has sharply criticised policy-making and project implementation in several key digital and internet-related areas, handing an unusual rebuke to a government which prides itself on its tech savvy and business-friendly image.

\nR Chandrashekhar, the president of the National Association of Software and Services Companies, and the organisation’s chairman CP Gurnani were both on hand during an exclusive interaction with ET on Monday as they voiced their perturbation with the way the government has handled important policy questions during the last few months.

On issues ranging from the proposed Goods and Services Tax Bill to rules governing taxi aggregators, the Nasscom executives said the government had acted without properly understanding the nature of neweconomy businesses. The guidelines for
FDI<\/a> in ecommerce also came under attack as being contrary to the spirit of the Digital India initiative being championed by Prime Minister Narendra Modi<\/a>.

\n“If you are a physical retailer, you can offer a store-closing or a winter sale below the cost price. No problem there, nobody will come and put handcuffs on you,” said Chandrashekhar.

\nChandrashekhar, a former IAS officer, was the top bureaucrat in the telecom department before becoming Nasscom president in 2013. “If you happen to be doing it electronically, you are violating the law. These are instances of bringing in restrictions on electronic transactions which actually don't exist in the physical world.”

The indictment of the government's performance on a broad range of issues related to startups and technology illustrates buildup of frustration among neweconomy companies whose reactions have largely been adulatory so far. As funding slows down, and business operations run the gauntlet of regulations, the sector is becoming vocal in expressing its disenchantment. Over the past two days, the Internet and Mobile Association of India which groups companies such as
Google<\/a> and Twitter, has ripped the model GST law, saying it has “pushed the internet economy under the bus”.

\nThe proposed law was also denounced by Nasscom for its potential to add significantly to regulatory burden of software services companies, which employs about 3.5 million professionals and contributes to over $100 billion in exports.

\n“If the Bill is passed in the same way it is currently envisaged, then people will be required to take as many as 100 different registrations, 100 different compliances,” said Chandrashekhar, who under chief minister N Chandrababu Naidu established India’s first information technology department in the government in Andhra Pradesh. “And if you thought that was mind-boggling, the more difficult part is that a transaction which has been happening seamlessly across the country will have to then be somehow disaggregated and mapped on to states,” he said.

\nState governments are also seeking to impose higher taxes on transactions conducted online, or blocking these altogether, putting ecommerce firms at a comparative disadvantage in relation to traditional retailers, he said. Besides, the new ecommerce guidelines also seek to punish those who operate online platform for acts of omission or commission by others, which is unfair. “These are things which betray the lack of deeper understanding of issues,” he said.

\nNET GAIN IN JOBS<\/strong> Gurnani, who is also the CEO of IT services company Tech Mahindra which had revenue of $4 billion in 2015-16, said that while changes in technology and business models are disrupting the software industry, traditional players such as Wipro and IBM are well-prepared for the challenge. “Our belief is there would be a 20-25% reduction in the traditional workforce, but overall, growth will happen because the new jobs created will be higher than the reduction,” he said.

Gurnani, 57, said it is unwise to write off legacy software services companies, and pointed to premature obituaries of hotels after advent of home-sharing marketplace
