<\/span><\/figcaption><\/figure>NEW DELHI\/ MUMBAI: The Telecom Regulatory Authority of India (Trai<\/a>) has expressed that the new broadcasting framework – notified on January 1st this year and challenged by the broadcasters<\/a> in the Bombay high court – would empower consumers to choose TV channels<\/a> of their choice. This is despite the fact that the high court is currently hearing the final arguments in the matter.

Trai is of the view that non-implementation of amended
tariff order<\/a> is leading to chaos and would bring back discriminatory practices in the sector.

“Non-implementation of January 2020 amendments is jeopardising the business process, which has been harmonised after 2017 Regulatory framework and the delay and uncertainty in the implementation will again bring back non-transparency and discriminatory practices in the sector, wherein industry was full of litigation and there was no choice of channels to consumers,\" Trai chairman
Ram Sewak Sharma<\/a> told ET.

The top official added that it would not be appropriate to further comment on the issue which is sub-judice, but added that any further delay in the implementation of the amendments would definitely affect the consumers adversely.

The division bench of Justice AA Sayed and Justice Anuja Prabhudessai at Bombay High Court have started final hearings in the matter via video conferencing after allowing all the parties to make any additional submissions by August 31st.

The court also asked the regulator to refrain from taking any coercive action until the final judgment is pronounced.

Initially, the court, after hearing petitions by the Indian Broadcasting Foundation (
IBF<\/a>), the Film and TV Producers’ Guild of India and other broadcasters, had reserved the order on March 4th. However, as the court had not given any interim relief, Trai on July 24th directed broadcasters to company with the new amendments of the new tariff order (NTO 2.0) by August 10th. This made all the petitioners move the court once again.

While the matter remained under consideration of the court, Trai, according to Sharma, continues to receive a large number of complaints asserting that consumers are being denied the benefits of the amended regulations and tariff order by some broadcasters.

Some stakeholders such as direct-to-home (DTH) operators and multiple system operators (MSO) have though partially implemented the revised NTO while the resistance by the broadcasters, continues to further delay benefits to millions of subscribers as envisaged, he said.

In these circumstances, Sharma said, it was expected that the broadcasters would implement the provisions of Tariff Amendment Order 2020 and Interconnection Amendment Regulations 2020, in the interest of the consumers.

The broadcasting watchdog is also optimistic about the implementation of the long pending ad-cap matter, which restricts broadcasters from running ads for more than 12 minutes per clock hour.

The ad cap matter is under a stay from the Delhi high court and the next hearing is set for September 27.

The regulator wanted broadcasters to implement 10 minutes of advertising and 2 minutes of self-promotions in an hour that was originally introduced in 2012, following the multitude of complaints from consumers.

“We are not in a hurry as the matter is already much dragged, and the regulator is empowered by Act of the Parliament,” a Trai official added when asked about the urgency as alleged by broadcasters.

Broadcasters feel that implementation of both – NTO 2.0 and ad cap – will seriously affect the business viability of the channels as first restricts the channel pricing and reach while other hits ad revenues.
