NEW DELHI: The Supreme Court<\/a> of India on Wednesday appointed an expert committee to look into Pegasus<\/a> snooping controversy, the scandal that had allegedly compromised the privacy of individuals and institutions.

A bench comprising Chief Justice N V Ramana and Justices Surya Kant and Hima Kohli said the three-member committee will be headed by former apex court judge RV Raveendran. Citing national security, the Centre had refused to file a detailed affidavit in the matter.

The apex court asked the expert panel to prepare its report expeditiously and posted the next hearing on batch of pleas after 8 weeks.

The apex court in its opening remark said, \"We live in the era of information and we must recognise that while technology is important, it's important to safeguard the right to privacy.\"

\"Every citizen of the country must be protected from violation of their right to privacy and Pegasus snooping allegation is chilling in nature and court must find out the truth,\" the top court said.

Here are the key points from the court's observation-

* Supreme Court said there has been no specific denial by Centre in the issue, thus we have no option but to accept the submissions of petitioner prima facie and we appoint an expert committee whose function will be overseen by the court.

* The SC said the Right to Privacy violation needs to be examined.

* Indiscriminate violation of the right to privacy of citizens cannot be allowed, said SC. \"There is serious concern of foreign agency involvement by surveilling Indians,\" the court said.

* The Committee has been formed to probe the falsity and discover truth in
Pegasus row<\/a>, the court said.

* It has chosen renowned experts to be a part of the three-member committee.

* The committee will be headed by RV Raveendran, former Supreme Court Judge. Other members will be Alok Joshi and Sandeep Oberoi.

* The top court further said that initially when petitions were filed court was not satisfied with the petitions filed based on newspaper reports, however, various other petitions were filed by the ones who were direct victims.

* The court said that it was compelled to appoint the committee as the response of the Centre on snooping allegation was vague.

* The court that it gave ample opportunity to Centre to assist the court and respond to the allegation but Centre's limited affidavit did not shed any light on the issue.

* The observed that government cannot be given a free pass by raising national security issues and the court cannot remain a mute spectator when there is a serious allegation of violation of citizens right.

* The court further said it prima facie accepts the allegations raised in the petition on Pegasus snooping and appoint the committee to get to the bottom of the matter.

How does it work?

* ‘Pegasus’ is a spyware used to snoop into handsets. It has been claimed that even a missed video call on
WhatsApp<\/a> could give Pegasus complete access to users' smartphones.

* It enabled opening up of the handsets and the operator installing the spyware on the device without the owner’s knowledge.

* This resulted in the hacker accessing the user’s data including passwords, contacts, calendar events, text messages and even live voice calls from messaging apps.

The 2019 attacks and WhatsApp's complaint<\/strong>

* After the 2019 attacks, WhatsApp in its complaint filed in California said the attack happened through its video calling feature.

* It said, Pegasus is capable of surveillance on three levels: initial data extraction, passive monitoring and active collection.

* The software was used to hijack smartphones running on
iOS<\/a>, Android<\/a> and BlackBerry operating systems.

* The spyware leaves no trace on the device, consumes minimal battery, memory and data consumption and comes with a self-destruct option that can be used any time, the complaint further added.

Earlier Supreme Court's observation<\/strong>

* The Bench had said that it intends to set up an expert committee to probe into the reports alleging the government of using Israeli software Pegasus to spy on politicians, activists, and journalists.

* The apex court on September 13 had said it will pass an interim order in two-three days on pleas seeking an independent probe into the alleged Pegasus snooping row.

* Several petitions are pending before the top court seeking a court-monitored probe into the reports of the government allegedly using Israeli software Pegasus to spy on politicians, activists and journalists.

* The Centre had earlier told the apex court that it was willing to set up a committee of independent experts to examine all aspects of the alleged Pegasus snooping row.

* It had maintained that what software was used for interception in the interest of national security can't be open for public debate.

Pleas filed before court

* There were many pleas filed before the top court by senior journalists N Ram and Sashi Kumar, Rajya Sabha MP John Brittas of Communist Marxist Party of India (Marxist) and advocate ML Sharma, former Union minister Yashwant Sinha and RSS ideologue KN Govindacharya.

* Journalist Paranjoy Guha Thakurta, SNM Abdi, Prem Shankar Jha, Rupesh Kumar Singh and Ipsa Shatakshi, who are reported to be on the potential list of snoop targets of Pegasus spyware, had also approached the top court along with The Editors Guild of India (EGI) among others.

* The pleas sought inquiry headed by a sitting or retired judge of the top court to investigate the alleged snooping.

* The plea said that the targeted surveillance using military-grade spyware is an unacceptable violation of the right to privacy which has been held to be a fundamental right under Articles 14, 19 and 21 by the Supreme Court in the KS Puttaswamy case.
