<\/span><\/figcaption><\/figure>NEW DELHI: The Telecom Regulatory Authority of India (Trai<\/a>) is examining if tariff and broadcast rules are being violated by some recent fixed line broadband plans<\/a> offered by Bharti Airtel<\/a> and Reliance Jio<\/a> and has sought responses from the telcos, a senior official said.

The telecom and broadcast regulator’s move came after Bharti Airtel asked it to block the recently launched
JioFiber Backup plans<\/a>, saying they were predatory, hurt consumer interests, hindered competition and disturbed the level playing field in the DTH digital TV space. Jio has rubbished the complaint, and asked Trai to warn Airtel not to make frivolous complaints.

Amidst this, India’s largest DTH operator,
Tata Play<\/a> (formerly Tata Sky), accused both operators of predatory pricing for bundling live TV channels and over-the-top (OTT<\/a>) apps with their respective broadband offers.

\"We received complaints from both sides (Airtel and Jio) as well as Tata Play. We are giving the opportunity to respond to the accusations raised,\" a senior Trai official told ET.

\"The Trai is undertaking a complaint analysis and examining if they (
JioFiber<\/a>) are violating tariff norms by offering live TV channels through broadband plans and also checking whether broadcasting regulations are being followed,\" the official added.

The official said the regulator is trying to get responses within a week so that it can expeditiously decide the matter. Still, Trai may take a month to finally settle the matter as multiple divisions would deliberate on the matter before finally placing it before the authority for a final decision.

ET’s emailed queries sent to the companies did not elicit a response as of press time.

Sunil Mittal-driven Bharti Airtel, in its complaint to regulator on March 29, said that its arch-rival Jio was allowing broadcasting of live TV and over-the-top (OTT) apps which is contrary to broadcasting and downlinking rules. India’s second largest telco, Airtel, also has home broadband and direct-to-home (DTH) businesses.

“Offering 400-550 live TV channels as part of a broadband offering well below market cost with a view to reduce competition is a clear case of predatory pricing and is in contravention of the TTO-1999 and requires immediate attention of the authority,” Airtel in its letter to Trai said.

Jio, which also offers home broadband services with access to content apps through a set top box, contended that it hasn’t violated any broadcasting or telecom rules, and said Airtel's complaint was meant to corner the Mukesh Ambani-owned telecom company.

In its letter to Trai dated April 6, Jio, countering Airtel said, “This complaint (by Airtel) is a deliberate, malicious attempt by Airtel to defame Reliance Jio’s consumer-friendly tariffs in order to protect its narrow interests.”

Tata Play, on its part, cited the recent JioFiber and Airtel Black plans that offer a mix of live TV channels and OTT apps. “This move of predatory pricing by telecom and
boadband operators<\/a> is damaging and detrimental to the DTH business, which is already saddled with multiple regulatory restrictions and is unable to negotiate with broadcasters and give such lucrative discounts to its subscribers,” it said, in its complaint.

The sparring comes as India’s broadband speeds and fixed-line (home broadband) penetration improves with Airtel, Jio and Tata Play fighting it out for a higher share of customer market and wallet share.
