Companies and staffing firms said a new Haryana law reserving private sector jobs for people belonging to the state will likely erode competitiveness and disrupt the post-pandemic recovery, possibly forcing some enterprises to consider relocating.

The state’s IT, commercial and industrial hub of Gurgaon-Manesar is home to the offices of Pepsi, Coca-Cola, Google<\/a>, Nestle, Hindustan Unilever, Reckitt Benckiser, American Express, Samsung<\/a> and others, as well as the factories of Maruti Suzuki<\/a> and Hero MotoCorp.

The Haryana law reserving 75% of private sector jobs with monthly pay of up to Rs 50,000 for people of the state has been approved by the governor, chief minister Manohar Lal Khattar said on Tuesday. The state legislature had passed the legislation last year. Some experts said it could trigger a dangerous trend if other states adopted similar legislation.

The Haryana State Employment of Local Candidates Bill applies to private companies, societies, trusts and partnership firms. It’s aimed at reducing unemployment and discouraging migrants, which has a “significant impact” on local infrastructure and leads to the “proliferation of slums,” according to the state government. Domicile status will be given to those born in the state or living there for at least 15 years. The reservation, which will initially apply for 10 years, was a poll promise of
Dushyant Chautala<\/a>'s Jannayak Janta Party (JJP), the BJP's coalition partner in the state.

The Haryana move will hit the IT and BPO sector in
Gurugram<\/a>. Apart from Google<\/a> and Microsoft<\/a>, it’s also home to firms such as Tata Consultancy Services<\/a> (TCS), Infosys, Wipro and HCL Technologies besides outsourcing firms such as Genpact and Convergys, along with a number of startups including Zomato and Roposo. Haryana has said previously that nearly 5% of global BPO workers are housed in Gurugram<\/a>.

“As a general principle, all industry associations including CII have taken the view that reservation of this kind is not conducive to the competitiveness of the industry,” said
Maruti Suzuki<\/a> chairman RC Bhargava

He declined to give his personal views on the matter before the rules were finalised.

The bill could impede business recovery, said a senior executive at a large Gurgaon-based consumer-facing multinational firm. “It will require widespread recalibration of jobs and paperwork, which will delay processes,” the person said.

The bill stipulates that companies can hire from outside the state if suitable local candidates cannot be found but the government has to be informed.

“The move goes against the basic principle of meritocracy that acts as the foundation for businesses to grow and remain competitive,” said Rituparna Chakraborty, cofounder of staffing firm TeamLease Services. “Such protectionism when clearly there are encouraging signs of economic recovery should not scare employers, costing the state the much-needed jobs--now and in the long run.”

The industrial belt across Gurgaon and Manesar is a hub for hundreds of companies across sectors such as outsourcing, IT services, automobiles, consumer goods and electronics.

“Whilst we encourage employment generation, if we could find a better solution, it would’ve been easier,” said Sunjay Kapur, chairman of automotive components maker Sona Comstar and vice president of the Automotive Component Manufacturers Association of India (ACMA). “We don’t want to be in a situation where we are not competitive with other states. We want to hire the best talent available, we don’t necessarily want to hire from outside. If there are restrictions, it could become a challenge.”

Recruitment and staffing firm CIEL HR Services’ founder Aditya Misra said the disruption could be expensive for industry and state GDP unless adequate clarity on enforcement is provided and time allowed for the ecosystem to prepare.

“Companies aren’t ready yet to implement this because their systems do not track the origin of a person and it’s difficult to identify who’s from Haryana and who isn’t. Secondly, they might not be able to recruit locals due to talent availability issues,” Misra said.

CIEL HR Services has 12,000 temporary employees, of which about 1,500 with salaries below Rs 50,000 are working in Haryana and are not locals.

“It was a poll promise and now getting implemented. The challenge will be in industrial and commercial hubs like Gurgaon and we have to see how this law will be imbibed and enforced,” said Misra. He said most positions below a monthly salary of Rs 50,000 are filled by non-locals due to skillset availability and locals not being willing to take up some kinds of jobs.

“This is populist and somewhat unnecessary,” said an executive at a large Gurgaon-based company. “It will impact jobs in our manufacturing plants at a time when we were re-hiring since we expect consumption to pick up this year. Now we will require large-scale recalibration of hiring at manufacturing plants.”

The HR head of one of the consulting firms that has offices in Gurugram said the move risked triggering copycat moves.

“This is going to be a dangerous trend,” he said. “If each state government reserves for locals, then places like Bengaluru, Pune, Hyderabad will dry up as they have a significant migrant talent. If people want to go to these places they would be shooed away due to draconian acts. This is not a good sign.”
