Indian Broadcasting and Digital Foundation, an umbrella organisation of private TV broadcasters<\/a>, and many other private channels had moved the SC challenging the Bombay HC decision alleging that NTO 2.0 seriously interfered with their fundamental right to carry on a particular trade or profession guaranteed under Article 19(1)(g) of the Constitution, said the report.
Appearing for the appellants, senior advocate Mukul Rohatgi, supported by senior advocates Gopal Subramaniam, N K Kaul, Darius Khambatta, Amit Sibal, Gopal Jain and Nakul Dewan argued before a bench of Justices U U Lalit and S R Bhat that when the government does not regulate the price of cinema tickets, why would it do so for price of TV channels.
<\/div><\/div>Even though Rohatgi and other senior advocates insisted for a stay on operationalising the NTO 2.0 citing infringement of fundamental rights, the bench said granting interim relief would not be proper. It posted a bunch of appeals against the Bombay HC decision for final hearing on November 30.

It is a well settled principle that public interest always overrides commercial interest, Mehta said. TRAI informed that many TV broadcasters and MSOs have already complied with NTO provisions. The HC had said NTO was to ensure that an effective a-la-carte choice was available to distributors without being handicapped by perverse pricing of bouquets by broadcasters at wholesale level.
