While India has provisions in the IT Act for intermediaries such as Facebook to report any cyber attact, it is not being implemented, say experts, adding that a data protection law in the country would have deterred companies from delaying the information to the government.

“Any breach that impacts Indian users have to be reported immediately to the regulator, in this case CERT. The existing IT Act has those provisions,” said Pavan Duggal, cyber law expert, who worked on India’s cyber law. Facebook has an India entity and is governed by local laws of the country.

He said while the right to privacy has been mandated by the Supreme Court, it is applied only for state actors and not private entities such as Facebook. “A privacy law would make it all encompassing bringing all private companies that has any connection with an Indian user ,” said Duggal.

Last week, the ministry of electronics and information technology (Meity) asked Facebook to give an update on the extent of damage caused by the breach on Indian users. The social network has its largest userbase in India with about 270 million at the end of July, according to Statista website.

In the latest Facebook breach, attackers exploited a vulnerability in the code of the ‘View As’ feature that lets users see what their profile look like to others. Facebook has now fixed the vulnerability and launched an investigation. It also logged out the 50 million affected users and an additional 40 million after the revelations.

Facebook said it had taken immediate action and informed its users and advertisers and secured their accounts.

It did not disclose how many Indian users have been impacted in the breach as it was still investigating the matter. “We are in touch with Govt of India, to share preliminary information about the security issue we announced on September 28. We have taken immediate action and informed all our users, advertisers and secured their accounts,” a spokesperson said. “We are still working through the details of impacted users in India and will release more information once we have concluded our investigations.”
