In an increasingly digital world where OTT — internet messaging, calling and content apps – plays a major role in high data consumption by mobile users and ultimately benefiting telecom operators via high usage, a regulation on them will be a tricky issue.

Instead of bringing more regulations, the government can look at reducing the existing regulations i.e levies and taxes borne by the telecom industry. This could be a win-win situation for everyone. Or a light touch regulation could be

All this comes at a time when telecom players are planning to soon launch next generation technology 5G. The telecom industry maintains that TSPs are at a disadvantageous position compared to OTT players in the current structure with the former’s billions of dollar investments in networks.

OTT services are free for consumers and monetised via advertisements or use of customer data etc while telecom services are paid by consumers and licensed. The quality of services in OTT space depends on the quality of services of a telecom network provider. A telecom player has to meet quality of service norms as prescribed by Trai otherwise they are fines and other regulations. This has also been a main bone of contention as free voice calls and messaging over the internet at times clog the telecom player’s network. Apart from this, privacy, security, interception and roll obligations etc are dealt by telecom service providers.

Since the launch of 4G services, India has seen a tremendous rise in data consumption by mobile users. The average traffic per smartphone in India is the second-highest globally at 18.4 GB per month in 2021 and is projected to grow to around 50 GB per month in 2027. The OTT industry has contributed significantly to this rise.

To look into the various intricacies of a
new regulatory framework<\/a> and whether it is required or not, the department of telecommunications (DoT) has asked telecom regulator Trai for its views on the whole issue.

Pertinent to mention here that in 2018, the regulator had issued a consultation paper on Regulatory Framework for Over-The-Top (OTT) Communication Services. In 2020, after many consultations and deliberations, Trai had opined that there was no need for any regulatory framework on OTT players at the moment.
