The ratings firm added that the draft Indian Telecommunication Bill, 2022 intends to provide one-stop clarity on several key aspects that have affected the telecom industry over the past two years.

On Wednesday, the
Department of Telecommunications<\/a> (DoT) released a draft of a new telecom bill<\/a> that aims to ease the regulatory regime, and allow faster deployment of telecom infrastructure in the country.

The Centre also lays an emphasis on some of the pertinent issues such as the spectrum management and over-the-top (OTT) applications by bringing them into the ambit of law with a light-touch regulation.

However, the agency believes that the bill might not accelerate the resolution process of insolvent telecom service providers.

The bill stipulates that the ownership of spectrum remains with the government, and hence implies that the value of spectrum cannot be sold by creditors under the Insolvency and Bankruptcy Code.

\"The government reserves the right to take back the spectrum if the ailing telecom operator fails to pay government dues, further adding concerns on the operational viability of such telcos,\" Ind-Ra said.

The
National Company Law Appellate Tribunal<\/a>, through its order dated July 2021, had ruled that government dues must be cleared before a stressed telco is admitted to insolvency proceedings.

\"Impact of the bill on the resolution process needs to be seen, given that the ailing telcos may not have the financial flexibility to clear government dues and\/or have the operational cash flows to service the ongoing regulatory charges.,\" the agency added.

While, the draft law encourages due obligations to be followed, merger and acquisition (M&A) is proposed to be a simple procedural function where only intimation is needed rather than a permission, according to the department.

The proposed framework aims to consolidate the telecom sector's current governing framework that includes
Indian Telegraph Act<\/a> 1885, Indian Wireless Telegraphy Act 1933, and The Telegraph Wires, and (Unlawful Protection) Act 1950.

The Centre has asked stakeholders to share their views on draft Telecommunications Bill, 2022 by October 20, and following the due process, it is likely to come into effect by mid-2023.
