He said the government doesn’t want to look at content or seek decryption of messages, but only to trace the origin of a message that has caused serious criminal offences.

“Onus is now on them (social media platforms). Rules are out — everyone will have to follow,” Prasad said in an interview. “If people are suffering because of misuse, should they not have a forum for redressal? We are only asking them to have a good, robust grievance mechanism… The government is not interested in interfering. They are welcome to do business in India and earn profits from India, which they are doing with 130-crore plus users.”

The government notified new regulations governing the digital media industry to ensure greater compliance with local laws on February 25. It mandated social media platforms such as Facebook, Instagram and YouTube to take down flagged posts within 36 hours of receiving a notice. Social media platforms that have over five million users will be required to appoint a chief compliance officer resident in India to ensure they abide by the rules, a nodal person of contact for 24x7 coordination with law enforcement agencies along with a “resident grievance officer.”

Prasad dismissed fears that the revised intermediary guidelines would provide a backdoor for India to become a surveillance state. “The guidelines are very clear,” he said.

“Only in cases of messages which are a threat to law and order and ones which are liable to punishment of five years or more are we seeking traceability,” he said.

Prasad said the government welcomed criticism. \"We welcome dissent and criticism, including that of the PM and all the ministers. But two things are not okay—abuse and misuse of platforms,\" the minister said. \"This needs to be curbed.\"

The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, under the Section 79 of the Information Technology Act, covers social media, digital media and over-the-top (OTT) platforms. Encrypted messaging apps, including WhatsApp,
Signal<\/a> and Telegram have been directed to trace the originator of contentious messages. They have to also introduce a mechanism for voluntary verification of the identity of users as a means to curb fake and anonymous posts on social media.

\"The traceability requirement is also very limited… I don’t want to decrypt or have content. I already have it… They have to find the mechanism to trace who began this thread,\" Prasad said. He was referring to the traceability clause that mandates messaging platforms to report to the government within 72 hours on the origin of messages that lead to offences that are serious in nature. \"That too will be done only after a court's order or in response to a request from a law enforcement agency,\" he said.

WhatsApp has been pushing back against the government’s traceability demand, maintaining that this will mean altering the architecture of its messaging platform. It doesn’t allow for traceability or finding the origin of a message without breaking end-to-end encryption, which it touts as a feature protecting the privacy of users.

Prasad said the government wants to quell abuse of social media.
