Tax experts at EY India<\/a> say that non-levy of GST on petroleum products like diesel could have a cascading tax impact for telecom tower companies, especially since the telecom sector is the second-biggest buyer of diesel after the railways.
\n“Telecom tower firms will continue to lose out as they won’t be able to set off their input taxes if petro-products like diesel continue to stay outside the ambit of GST,” Uday Pimprikar, Partner & Indirect tax practice leader for Telecom, Media & Technology sectors at EY India, told ET.
\nSince tower companies, typically, are huge consumers of diesel, continuation of central excise duties and state sales tax levies would have a cascading tax impact, jacking up their overall business costs.
\nPimprikar, in fact, said tower companies could collectively “miss out on input tax credits upwards of Rs 2,000 crore” on their annual diesel bills alone.
\nIndustry experts estimate the telecom sector spends roughly Rs 9000 crore a year to consume well over 200 crore litres of diesel. An official representing Tower & Infrastructure Providers Association (TAIPA) said tower companies like mobile carriers are also concerned about the potential impact of state-wise registrations for GST compliance.

\n“Ideally, the registration process should be kept simple since GST is meant to drive efficiency and not make tax compliance a cumbersome exercise, which will be the case if the government mandates state-wise registrations” said the TAIPA functionary.
TAIPA is an industry group representing tower companies such as Indus Towers<\/a>, Bharti Infratel, American Tower Corp, GTL, Reliance Infratel and Tower Vision among others.
\nThe Cellular Operators Association of India (COAI), which represents India’s biggest telecom operators such as Bharti Airtel, Vodafone India, Idea Cellular and Reliance Jio Infocomm, has already approached the finance ministry to pave the way for a single pan-India registration process for tax compliance under GST for the sake of administrative convenience.
\nTower companies and industry experts also want the government to clear the ambiguity on whether input tax credits will be available on passive infrastructure (read: towers, shelters that house power equipment at cell sites).
