JPC<\/a>'s recommendations have, in some cases, intensified the controversy around the Bill. But if pre-existing concerns were to persist in the new draft, the enactment of the law would merely have been delayed. Another round of stakeholder consultations would keep legislation behind the curve of technology change. Data protection is a dynamic endeavour, and the sooner the legal foundations are laid the easier it will be to alter the superstructure as the digital landscape unfolds.

India<\/a> is struggling with fundamental issues about privacy, even as other jurisdictions have granular data protection regimes in place. In some of these, data is better protected now than what India is proposing to do. The law, whichever route it takes, must address issues of regulatory overreach, ease of doing business and trade distortion. The government is expecting technology to fuel the next phase of India's development. To this effect, privacy protection that does not inhibit the digital economy is key. It is up to the government to find the shortest course to achieve this balance. It has already lost five years after the Supreme Court<\/a> upheld privacy as a fundamental right and sought a legislative framework to protect it.
